Rose Art Industries, Inc. and Hasbro Participate in CARU Self-Regulatory Forum

New York, NY - February 22, 2000 - The Children's Advertising Review Unit (CARU) of the Council of Better Business Bureaus, Inc. (CBBB), the advertising industry's national forum for voluntary self-regulation, recommended that Rose Art Industries, Inc. modify its Super Lite Art packaging to accurately prortray the product.

Rose's Art packaging for Super Lite Art, created in-house, was challenged by Hasbro, which maintained that the advertiser could not support its packaging claims.

In its evaluation, CARU questioned the size of the picture of the toy in relation to the size of the child. The picture on the packaging of a child and a large board or canvas could lead a child to believe that the Super Lite toy is larger than it actually is. The toy does not come with enough pegs to recreate the designs on the packaging. In white letters smaller and narrower than any on the packaging against a primarily white background there is the disclaimer "to create combined and filled in drawings as shown, you will need a bag of re-fill pegs" However to duplicate the designs on the packaging, more than one refill pack is necessary. CARU found the term "Design With Light," and the illustration on the packaging of the flashes or flecks of light to be deceptive, implying that the pegs are the source of light when in fact the source of light is a bulb. From the packaging it is not clear that the bulb must be purchased separately. Finally, use of the term "New" was a concern to CARU. The copyright on the packaging is dated 1997; there is no reference made as to what feature of the product is new.

Rose Art Industries, Inc. agreed to accept CARU's recommendations for its advertising. CARU appreciates the willingness of both parties to participate in this voluntary forum and acknowledges their efforts to foster truth in advertising.

CARU's inquiry was conducted under NAD/CARU/NARB Procedures for the Voluntary Self-Regulation of National Advertising. Details of the initial inquiry, NAD's decision and the advertiser's response will be included in the next NAD Case Report.
